JCT 21.2.1 Non-Negligence Insurance
Building contracts using the standard JCT forms can include clause 21.2.1 (or minor works contact 6.5.1) which sets out insurance requirements relating to the possibility of damage to property caused by collapse, subsidence, heave, vibration, weakening or removal of support or lowering or ground water caused by your building works. In simple terms it is insurance to cover you should a neighbour's property suffer damage as a result of the work carried out on your property.
Such a clause is most often seen in a contract where other buildings are in close proximity to the works. Depending upon the contract the policy will either need to be in the name of the property owner or jointly with the contactor.
Although contractors and architects might have public liability, contract works or professional indemnity policies these will normally not give the cover required by clause 21.2.1 so an extension to the contractors public liability policy or an additional policy will be required.
Without 21.2.1 insurance the contractor or employer could find themselves liable for the costs of damage suffered by neighboring properties and in breach of their contract.
