JCT 21.2.1 Insurance
Building contracts using the standard JCT forms can include clause 21.2.1 which sets out insurance requirements relating to the possibility of damage to property caused by collapse, subsidence, heave, vibration, weakening or removal of support or lowering or ground water caused by your building works. In simple terms it is insurance to cover you should your building work accidentally damage a neighbour's property.
Such a clause is most often seen in a contract where other buildings are in close proximity to the works. The contractor will be responsible for putting the insurance in place in joint names with the employer.
Most normal public liability, contract works or professional indemnity policies will not give the cover required by clause 21.2.1 so an extension to the contractors public liability policy or an additional policy will be required.
Without 21.2.1 insurance the contractor or employer could find themselves liable for the costs of damage suffered by neighboring properties and in breach of their contract.
